New York City has received a green light from the Biden administration to implement a retooled congestion pricing program, but the plan still faces lawsuits from opponents and anticipated pushback from incoming President-elect Donald Trump.

Congestion pricing will be the first of its kind across the country. The U.S. Transportation Department has approved New York ‘s plan to impose a $9 congestion charge for driving in Manhattan starting on Jan.

The Federal Highway Administration OK’d the final bureaucratic step Thursday for the revamped program to collect $9 tolls Street starting Jan. 5. The agreement gives the MTA permission to collect congestion tolls under the feds’ value pricing pilot program.

The plan is now scheduled to start just after midnight on Jan. 5. But despite this final government approval, congestion pricing could still be undone, even after its start date.
